These Terms of Service ("Terms") are a legal agreement between Volente Marketing (Pty) Ltd ("Company," "we," "us") and you (the "Client," "you," "your"). By engaging our services or using our website (volentemarketing.co.za), you agree to these Terms. If you do not agree, do not use our services.
Volente Marketing provides digital marketing services including:
SEO (Search Engine Optimization)
Google Ads management (paid search)
Email marketing automation
Web design and development
Brand strategy and messaging
Meta Ads (Facebook/Instagram advertising)
Social media management
POPIA/PAIA compliance consulting
GEO (Generative Engine Optimization)
3.1 No Long-Term Lock-In
All service engagements are month-to-month.
There are no long-term contracts unless explicitly agreed in writing.
3.2 Contract Termination
Either party may terminate the engagement with:
30 days written notice (email to [email protected] or from Client)
No penalty or additional fees
Final invoice due for services rendered through termination date
4.1 Service Fees
Service fees are clearly stated in:
Signed proposal
Email confirmation
Invoice
4.2 Ad Spend (Google Ads, Meta Ads, etc.)Ad spend is separate from management fees.
Client controls:
Daily budget
Campaign status (paused/active)
Ad spend amount
4.3 Invoice & Payment Terms
Invoices are issued monthly (first day of service month)
Payment due: 15 days from invoice date
Payment method: EFT transfer to Volente Marketing bank account
5.1 Our Commitment
Volente Marketing commits to:
Execute services as described in proposal
Provide monthly reporting on results
Communicate transparently about progress and obstacles
Optimize toward agreed-upon goals
Respond to inquiries within 1-2 business days
5.2 Client Responsibilities
Client is responsible for:
Providing access to necessary accounts (GA4, Google Ads, email platform, etc.)
Timely approval of proposals, content, and assets
Providing accurate business information and goals
Ensuring website/landing pages are functional
Providing landing page URLs and conversion tracking setup
Client receives:
Monthly performance reports
Metrics dashboards (Google Analytics, Google Ads, etc.)
Monthly strategy calls (based on tier)
Client maintains access to:
Google Analytics account
Google Ads account
Email platform account
Website/CMS account
You own your data. You are not locked in to Volente Marketing.
7.1 No Guarantees
Volente Marketing cannot guarantee:
Specific rankings (Google controls rankings, not us)
Specific lead volume
Specific ROI
Specific conversion rates
7.2 Our Commitment
We commit to:
Execute strategy as proposed
Optimize toward your goals
Report transparently
Stop work that isn't working
Pivot strategy if data suggests a better approach
8.1 Our Work Product
Deliverables created by Volente Marketing (ad copy, email sequences, website code, strategy documents) are:
Your intellectual property upon full payment
Licensed to you for your use
Cannot be resold by you to third parties without permission
9.1 Confidential Information
Both parties agree to:
Keep business information confidential
Not disclose Client data to third parties (except service providers)
Not use Client information for competing purposes
10.1 Informal Resolution
If a dispute arises:
Client contacts [email protected] with details
We respond within 5 business days
Both parties attempt good-faith resolution
10.2 Formal Dispute
If informal resolution fails:
Either party may seek legal remedies
Claims must be filed within 1 year of the event
Disputes are governed by South African law
11.1 Legal Compliance
Volente Marketing complies with:
POPIA (Protection of Personal Information Act) - Data privacy
PAIA (Promotion of Access to Information Act) - Public information access
Consumer Protection Act - Fair dealings
Broad-Based Black Economic Empowerment (B-BBEE) - Employment equity
11.2 Client Compliance
Client is responsible for:
Ensuring marketing claims are truthful and compliant
Obtaining necessary licenses and permits
Complying with consumer protection laws
Following industry-specific regulations
Volente Marketing may update these Terms with:
30 days written notice (via email or website)
Updated "Last Modified" date
Continued use of services constitutes acceptance of updated Terms.
